1. Acceptance of Terms

By accessing or using any PessAI product or service — including Sela and any other application within the PessAI ecosystem — you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please refrain from using our services.

2. Description of Services

PessAI provides AI-powered tools and applications designed for individuals and businesses in Ghana and across Africa. Our services may integrate with third-party platforms including Meta (Facebook, Instagram, WhatsApp) to deliver functionality. Features and availability may change over time.

3. Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. You must not:

• Misuse, reverse-engineer, or attempt unauthorized access to our systems.
• Use our services to violate any applicable local or international law.
• Transmit harmful, defamatory, or unlawful content through our platform.
• Interfere with the security or integrity of our services or infrastructure.
• Use our services in violation of Meta's Platform Terms or Community Standards.

4. Meta Platform Integration

Some of our services integrate with the Meta platform (including Facebook Login, WhatsApp Business API, and related products). By using these integrations, you also agree to:

• Meta Community Standards

We operate as a Meta Tech Provider. Our use of Meta APIs is subject to Meta's policies and we are responsible for ensuring our platform remains compliant.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use at hello@pessai.com.

6. Intellectual Property

All content, trademarks, logos, and intellectual property on PessAI platforms are owned by PessAI or their respective licensors. You may not reproduce, distribute, modify, or create derivative works without prior written permission.

7. Privacy & Data

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your data as described therein.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that our services will be error-free, uninterrupted, or meet your specific requirements.

9. Limitation of Liability

To the maximum extent permitted by law, PessAI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, even if we have been advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your access to our services at any time for violation of these Terms, without prior notice. You may also terminate your account at any time by contacting us.

11. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ghana.

12. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes. Continued use of our services after changes constitutes acceptance of the updated Terms.
